These Terms and Conditions (“Terms”) govern the participation of individuals and organizations (“Participants”) in programs run by The SWARM Initiative (“SWARM,” “we,” “us,” or “our”). By enrolling or participating in any of our programs, you agree to comply with these Terms in accordance with the laws of Kenya.
Eligibility
Participation is open to individuals and businesses legally operating in Kenya. Participants must be at least 18 years old or have legal guardian consent if underage.
Program Participation
Participants agree to engage with the programs responsibly and honestly. Misrepresentation or fraudulent activity may result in immediate disqualification or termination from the program.
Fees and Payments
Where applicable, fees or subscription costs must be paid promptly. Failure to pay may result in suspension or termination of services. All fees are inclusive of applicable Kenyan taxes unless otherwise stated.
Data Protection and Privacy
We collect and process personal information in accordance with the Kenya Data Protection Act, 2019. Personal data will be used solely for program administration and will not be shared without consent except as required by law
Intellectual Property
All materials, trademarks, logos, and content provided by SWARM remain our property. Participants may not reproduce or use such materials without prior written permission.
Liability
SWARM shall not be liable for any indirect, incidental, or consequential damages arising from participation in our programs. Participants assume all risks related to the use of materials or participation in activities.
Code of Conduct
Participants shall act respectfully towards others and adhere to ethical and legal standards. Harassment, discrimination, or abusive behavior will not be tolerated and may lead to removal from programs.
Termination
SWARM reserves the right to suspend or terminate participation for violations of these Terms or for any reason deemed necessary to protect the program’s integrity.
Dispute Resolution
Any disputes arising under these Terms shall first be addressed through amicable negotiation. If unresolved, disputes will be subject to the jurisdiction of Kenyan courts.
Amendments
We reserve the right to update or modify these Terms at any time. Participants will be notified of changes via email or our official website.
This Return Policy applies to physical products purchased through The SWARM Initiative, including compost bins and related equipment. Services provided under our programs are not subject to returns but may be subject to cancellation or modification under separate terms
